At Liquivida, LLC (“Liquivida,” or “we,” “our,” or “us”), we are committed to respecting your privacy. This privacy policy is designed to help you understand how we collect, use, and share information that we collect through the Liquivida websites, mobile applications, and other services we operate. Because we're an internet company, some of the concepts below are a little technical and can be confusing, but we've tried our best to explain things simply and transparently. If you do not agree with our policies and practices, your choice is not to use our Site. By accessing or using our Site, you agree to this Privacy Policy. This Privacy Policy may change from time to time. Your continued use of our Site after we make changes is deemed to be acceptance of those changes. Many of our locations are owned and operated by franchisees, who are independent businessmen and women. This Privacy Policy does not apply to our franchisees or to websites or mobile apps that they operate. Please reference our franchisees’ privacy notices for information on how they collect and use customer information.

What information we collect

You may be asked to provide personal information anytime you interact with us or one of our affiliates, such as when you use one of our websites or mobile applications (the “Site”) or visit our wellness centers. The types of information we collect depends on how you use our services.

Generally, you are under no obligation to provide your personal information. However, in certain cases, we may be unable to provide you with our services unless you provide your personal information.

We collect information in a few different ways:

1. When you give it to us or give us permission to obtain it

When you sign up or register with us to use our services (“Services”) and/or purchase products (“Products”) we offer, you voluntarily share certain information including your name, e-mail address, mobile telephone numbers, date of birth, your gender, photos of you, payment card information, and any other information you give us. When you transact with us, we collect information related to the transaction, such as your billing address, shipping address, driver’s license number, your medical history, records and copies of your correspondence (if you contact us), biometrics (including fingerprints), and health information, and other transactional data (“Personal Data”). You may also have the option to share other information about yourself such as your reviews or testimonials you may provide to be published or displayed (hereinafter, “posted”) on public areas of the Site or transmitted to other users of the Site or third parties (collectively, “User Contributions”). Your User Contributions are posted on and transmitted to others at your own risk. Although we limit access to certain pages, please be aware that no security measures are perfect or impenetrable. Additionally, we cannot control the actions of other users of the Site with whom you may choose to share your User Contributions. Therefore, we cannot and do not guarantee that your User Contributions will not be viewed by unauthorized persons.

2. When a third-party gives it to us

We may collect your information when a third-party provides your information to us for you to use our Services. For example, your authorized representative of one of the Providers may provide us with your information to support your order.

3. We collect technical information when you use our Services

When you use a website, mobile application or other internet service, certain internet and electronic network activity information gets created and logged automatically (“Automatic Data Collection Technologies”). This is also true when you use our Site. Here are some of the types of information we collect:

  • Internet or other electronic network activity information, such as information about your interactions with our Services. How we use your information

We collect and use your information so that we can operate effectively and provide you with the best experience when you use our Site. We also use the information we collect for the following purposes:

  • Fulfillment of purchases, such as completing your transactions and orders for products and services ordered by you; supplying Services and Products; and communicating with you about and keeping proper records of those transactions;

How and when we share your information

We do not share, sell, or otherwise disclose your Personal Data for purposes other than those outlined in this Privacy Policy. We may share the information we collect with:

1. Our wholly owned subsidiaries and affiliates

We share information within the Liquivida family of companies that help us provide our services or conduct data processing on our behalf. If we were to engage in a merger, acquisition, bankruptcy, dissolution, reorganization, or similar transaction or proceeding that involves the transfer of the information described in this policy, we would share your information with a party involved in such a process (for example, a potential purchaser).

2. Our Franchisees

We share information within the Liquivida franchisees to help them provide services to you.

  1. Third-party companies, service providers or business partners

We rely on third parties to perform a few contractual services on our behalf. To do so, we may need to share your information with them. For example, we may rely on service providers to enable functionality on our Services, to provide you with relevant content (including advertisements), to process your payments, to provide clinical telehealth services, provide IT and infrastructure support services, and ordering, marketing, and payment processing services, and for other business purposes. For example, Liquivida contracts with healthcare providers and their affiliated medical groups that are an independent medical group with a network of United States based health care providers.

4. Law enforcement agencies or government agencies

We may disclose information if we believe that disclosure is reasonably necessary to comply with a law, regulation or legal request; to protect the safety, rights, or property of the public, any person, or Liquivida; to enforce or apply our Terms and Conditions and other agreements, including for billing and collection purposes; or to detect, prevent, or otherwise address fraud, credit risk reduction, security or technical issues.

5. Your consent

We may share your information other than as described in this policy if we notify you, and you agree.

6. Other services

We may share your information with third parties to enable you to sign up for or log in to our Site, or when you decide to link your Liquivida account to those services. We may also disclose your Personal Data when we make use of email in order to respond to your queries about treatments, products or services. It is important to acknowledge that email guarantees neither confidentiality, integrity nor availability of information and that under certain circumstances can be intercepted by malicious actors.

How we use cookies

Due to differences between websites and mobile apps, you may need to take additional steps to opt-out of interest-based advertising for mobile applications. Do not track signals and similar mechanisms. Our website is not configured to read or respond to “do not track” settings or signals in your browser headings.

Your choices

We believe you should be in control of your Personal Data. We offer you choices on how you can opt out of our use of tracking technology, disclosure of your Personal Data for our advertising to you, and other targeted advertising.

  • Communications: You can choose whether we may contact you (such as through email, in-product notifications, push notifications, or text messages) for promotional purposes, or certain transactional messages, such as appointment or prescription notifications.   • Access: You can access and download your Personal Data processed by Liquivida.
  • Correction: You can correct certain account information, such as email address or phone number associated with your account. You can also make these changes in your account settings.
  • Deletion: You can delete your Liquivida account at any time. Please keep in mind we are required to retain certain limited information for legal and regulatory purposes, such as information that is part of your medical record.

We have also created mechanisms to provide you with control over your Personal Data:

  • Tracking Technologies and Advertising. You can set your browser or operating to refuse all or some cookies, or to alert you when cookies are being sent. If you disable or refuse cookies, please note that some parts of our Website may then be inaccessible or not function properly
  • Promotional Offers from Liquivida. If you do not wish to have your email address used by Liquivida to promote our own products and services, you can opt-out at any time by clicking the unsubscribe link at the bottom of any email or other marketing communications you receive from us or logging onto your account profile page. This optout does not apply to information provided to Liquivida as a result of a product purchase, or your use of our services.
  • Targeted Advertising. We belong to ad networks that may use your browsing activity across participating websites to show you interest-based advertisements on those websites. To learn more about interest-based advertisements and your opt-out rights and options, visit the Digital Advertising Alliance and the Network Advertising Initiative websites (www.aboutads.info and www.networkadvertising.org ). Please note that if you choose to opt out, you will continue to see ads, but they will not be based on your online activity. We do not control third parties’ collection or use of your information to serve interest-based advertising. However, these third parties may provide you with ways to choose not to have your information collected or used in this way. You can also opt out of receiving targeted ads from members of the NAI on its website.

Just to clarify - we do not sell your personal information to any third party in exchange for monetary consideration. However, like most companies, we do share information that could be considered a "sale," as defined by certain state privacy laws. This includes sharing identifiers, commercial information and internet or other electronic network activity with advertising networks and website analytics companies. You can always opt out of this practice by updating your cookie preferences.

To complete your request regarding your privacy choices, you may be asked to provide additional information to verify your identity, such as specific identification information associated with your account. We will compare the information you provide to any information we may have in our possession in order to verify your request. The information you provide must match the information we have in our possession. This measure is in place to help ensure that your personal information is not disclosed to any person who does not have the right to receive it. The information collected through this process will be used for verification purposes only.

Your rights with respect to health information

You have certain rights with respect to your health information, in accordance with applicable state and federal medical privacy laws. All rights and authorized uses of your health information may be found in Liquivida’s Notice Regarding Information in Your Medical Record.

Children's data

Our Website is not intended for children under 18 years of age. No one under age 18 may provide any information to or through the Website. We do not knowingly collect Personal Data from children under 18. If you are under 18, do not use or provide any information on our Website or on or through any of their features, including your name, address, telephone number, email address, or any screen name or username you may use. If we learn we have collected or received Personal Data from a child under 18 without verification of parental consent, we will delete that information. Data Security

Information transmitted over the Internet is not completely secure, but we do our best to protect your Personal Data. You can help protect your Personal Data and other information by keeping your password to our Site confidential.

We have implemented measures designed to secure your Personal Data from accidental loss and from unauthorized access, use, alteration, and disclosure. We use encryption technology for information sent and received by us.
